Terms and Conditions

Please read these terms carefully before using our website or making a purchase.

Last updated: 22/09/2025

1. Introduction

These Terms and Conditions ("Terms") govern your use of the Louw Wines website at www.louwwines.com ("Website") and your purchase of products from Louw Wines ("we", "us", or "our"). Our registered address is Unit A, 82 James Carter Road, Mildenhall, Suffolk, United Kingdom, IP28 7DE.

By accessing our Website, browsing our products, or making a purchase, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Website or services.

2. Acceptance of Terms

By using our Website, you confirm that you are at least 18 and legally capable of entering into binding contracts. You agree to use our Website in accordance with these Terms and to provide accurate and complete information.

3. Age Verification and Legal Requirements

Age Verification

You must be 18 years or older to purchase alcoholic beverages from us. By using our Website and making a purchase, you confirm that you are of legal drinking age. We may request proof of age at any time, including at the point of delivery.

Our Website uses an age verification system that stores a cookie on your device for 24 hours to confirm your age verification status. This is a legal requirement for alcohol sales.

Responsible Alcohol Sales

We are committed to responsible alcohol sales and reserve the right to:

  • Refuse service to anyone who appears intoxicated
  • Limit quantities of alcohol sold to any individual
  • Request age verification at any point in the ordering or delivery process
  • Refuse delivery if proper identification cannot be provided
  • Refuse or cancel orders if fulfilling them would breach local licensing restrictions

4. Products and Pricing

Product Information

We strive to ensure all product information, including descriptions, vintage years, alcohol content, and tasting notes, is accurate. However, wine is a natural product and variations may occur. Product images are for illustration purposes and actual products may vary slightly.

Pricing

All prices are displayed in British Pounds (GBP) and include VAT where applicable. Prices are subject to change without notice, but any changes will not affect orders already confirmed.

Stock Availability

All orders are subject to stock availability. If an item becomes unavailable after you have placed your order, we will contact you to offer alternatives or process a refund.

5. Ordering and Payment

Placing an Order

When you place an order, you are making an offer to purchase the products at the prices then in effect. We reserve the right to accept or decline your order at our discretion.

You will receive an email confirmation when your order is placed successfully, containing your order details. Please check this carefully and contact us immediately if there are any errors. This confirmation does not constitute acceptance of your order – acceptance occurs when we dispatch your order.

Payment Processing

All payments are processed securely through Stripe. We accept major credit and debit cards. Payment is required in full at the time of ordering. We do not store your payment card details – these are handled entirely by our secure payment processor Stripe, which is PCI DSS compliant.

6. Delivery and Shipping

Delivery Areas

We currently deliver within the United Kingdom. Delivery charges, if applicable, will be clearly displayed during the checkout process.

Delivery Times

We aim to deliver within the quoted timescales, but these are estimates and not guaranteed unless agreed in writing.

Age Verification at Delivery

The person receiving the delivery must be 18 or over and may be required to provide valid photographic identification. If adequate identification cannot be provided, we reserve the right to refuse delivery.

Delivery Issues

Please inspect your order upon delivery and report any damage or discrepancies within 48 hours. Risk in the goods passes to you upon delivery.

7. Returns and Refunds

Your Right to Cancel

You have the right to cancel your order within 14 days of receipt without giving any reason, provided the bottles are unopened and in their original condition. You must notify us of your cancellation within 14 days of receipt and return the goods within 14 days of giving us notice.

The cost of returning products is at your expense unless the products were faulty or we sent the wrong items.

Faulty or Damaged Products

If you receive damaged products or believe a wine is faulty (corked or otherwise defective), please contact us within 48 hours of delivery. We may arrange collection for analysis and will provide a replacement or refund if the product is confirmed as faulty. Your statutory rights under the Consumer Rights Act 2015 are not affected by these Terms.

Refund Processing

Refunds will be processed to your original payment method within 14 days of us agreeing to the refund. The refund will include the price paid for the products and original delivery charges (if the entire order is being returned).

Exceptions

We cannot accept returns of products that have been opened or consumed. For wine over 10 years of age, we make reasonable efforts to verify provenance but cannot guarantee quality due to the nature of aged wine – these products are sold "as seen".

8. Customer Account and Data

Account Creation

When you place an order, we create a customer account using the information you provide. This includes your name, email address, phone number, and billing/shipping addresses.

Data Protection

We take your privacy seriously. Please see our Privacy Policy for details of how we collect, use, and protect your personal information.

Communication

We will use your contact details to communicate with you about your orders as set out in our Privacy Policy.

9. Website Use and Intellectual Property

Our Website may contain links to third-party websites. We are not responsible for the content or practices of these external sites.

10. Limitation of Liability

To the fullest extent permitted by law, our liability to you is limited as follows:

  • We exclude all liability for any loss of profits, loss of business, or indirect or consequential losses
  • Our total liability to you for any claim shall not exceed the value of the products concerned or £100, whichever is higher
  • Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law

We provide our Website and services "as is" and make no warranties about their availability, accuracy, or fitness for any particular purpose.

11. Force Majeure

We shall not be liable for any failure or delay in performing our obligations if such failure or delay is due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, pandemic, government regulations, or supplier failures.

12. Governing Law and Jurisdiction

These Terms are governed by English law, and disputes will be subject to the non-exclusive jurisdiction of the English courts.

13. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices or legal requirements. Any changes will be posted on this page with an updated "Last updated" date. Continued use of our Website after changes are posted constitutes acceptance of the revised Terms.

14. Miscellaneous

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
